These terms govern your use of StackSwap and its features (including StackScan, stack analysis, and related content). By accessing or using the service, you agree to them. If you do not agree, do not use StackSwap.

1. Service description

StackSwap provides software that helps you document and analyze your go-to-market (GTM) stack — tools, overlap, rough economics, and similar signals — and produces reports with estimated savings, tradeoffs, and recommendations. You can use much of the product without creating an account; we may add or change features (including team or collaboration tools) over time.

The service is informational. Outputs depend on what you enter, modeled assumptions, and available data. They are not promises of results.

2. Not financial, legal, or procurement advice

StackSwap is not a law firm, accounting firm, investment adviser, or procurement consultant. Nothing on the platform is financial, legal, tax, or professional procurement advice.

You are responsible for your own decisions — including contracts, budgets, vendor selection, compliance, and security. Use your own judgment and consult qualified professionals when needed.

3. Use of the service

You agree that you will not:

  • Break the law, infringe others' rights, or submit data you don't have a right to use.
  • Abuse, disrupt, or attempt to overload the platform; probe or bypass security; or access non-public areas without permission.
  • Scrape, crawl, or harvest the service at scale; use automated means to extract our models, reports, or data except through interfaces we expressly provide.
  • Reverse engineer, decompile, or attempt to extract source code or models except where the law allows.
  • Misrepresent affiliation with StackSwap or use the service to send spam or misleading communications.

We may suspend or limit access if we reasonably believe you have violated these terms or pose a risk to the service or other users.

Shareable report links. If you create a link to a report, you control who receives it. Anyone with the link may see what that view is designed to show. See our Privacy Policy for more.

4. Accuracy disclaimer

Analysis reflects models, benchmarks, and inputs you provide. Vendor pricing changes, discounts, entitlements, and your real usage may differ. Savings figures are estimates, not audited numbers.

Always validate material decisions — especially spend, renewals, and security — directly with your organization and vendors.

5. Intellectual property

StackSwap owns the platform, branding, software, templates, and aggregated know-how behind the service, subject to the licenses below.

You retain ownership of your inputs (for example the stack details you type in). You grant StackSwap a non-exclusive license to host, process, and display those inputs to operate the product — including generating reports, improving the service, and producing anonymized aggregates as described in our Privacy Policy.

6. Payments

Some capabilities may require a one-time purchase (for example unlocking a full report). Fees, taxes, and what is included are shown at checkout. Payments are processed by Stripe; StackSwap does not store your card details. Team or subscription plans may be offered separately; if so, their billing cadence and renewal terms will be presented before you buy.

Paying for StackSwap does not guarantee any level of savings, ROI, or vendor outcomes. Refunds, if any, follow the policy stated at purchase or as required by law.

7. Termination

You may stop using StackSwap at any time. We may modify, suspend, or discontinue all or part of the service; where reasonable, we will try to give notice. Provisions that by their nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

8. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACKSWAP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION MADE BASED ON ESTIMATES OR RECOMMENDATIONS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO STACKSWAP FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100) IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You will defend and indemnify StackSwap against third-party claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the service, your content, or your violation of these terms, except to the extent caused by our gross negligence or willful misconduct.

9. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. You agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute, subject to mandatory consumer protections in your home jurisdiction where applicable.
